Terms of Service
These Terms of Service ("Terms") explain how Jace, operating as Jace Web Design, provides website services and related support. By using this website, submitting a request form, or purchasing services, you agree to these Terms.
1. Services covered by these Terms
Jace Web Design provides custom website design and development services, with optional monthly care plan support and optional paid extras. For published tiers, what is included is described on this website; your website build for that tier is confirmed on your invoice or in email. Optional extras (extra page, photography coordination) are purchased through separate public checkouts on the Extras page and are not part of the three-part build payment schedule unless we agree otherwise in writing. Custom or non-list work is described in a quote or written agreement when applicable.
2. Project scope and change requests
- Work is performed based on the published package tier you purchased (Starter, Business, or Growth), plus paid extras (extra page, photography) only after you have paid for them on the Extras page or as otherwise agreed in writing, or based on a custom quote for projects that are not a list package, as described on the Pricing page.
- The website build includes the structured revision rounds for that tier on the published package comparison (for example, one or two rounds after the first full draft, depending on the package). Revisions are focused feedback within what that package includes, not open-ended redesigns.
- Requests outside what your package includes (or outside a custom quote) may require a separate quote, timeline update, or both.
3. Pricing and payment terms
Published pricing on this website is part of the offer framework; your website build for a tier is confirmed on your invoice or in writing (for example by email or quote) so the amount you pay matches what you purchased.
- Website build: Fees follow your package tier (or a custom quote). Standard schedule: 40% deposit to start; 30% due at the first revision meeting; 30% due before final handoff. Dollar amounts are calculated from your invoice total for the build. Submitting the request form does not charge you. On this site, public checkout covers the 40% deposit for published Starter, Business, or Growth tiers (and optional care plan). Optional extras (extra page, photography) use the separate Extras checkout. Custom or non-list projects typically use a payment link or invoice provided in writing. Installments after the deposit may be satisfied through a payment link, invoice, or other method provided in writing. The amount charged should match your invoice or written agreement.
- Refunds: The 40% deposit may be refunded only under the twenty-four (24) hour rules in the Refund and cancellation policy. The two 30% installments are strictly non-refundable once paid, as stated in that policy.
- Optional care plan ($99/month) and optional extras on the Extras page are described on the main site; pricing for future engagements may change for new clients.
- Payments are processed through third-party providers (for example Stripe via payment links). Card data is handled by the processor, not stored on this site.
Refund, cancellation, and care plan billing details are governed by the Refund and cancellation policy, which is incorporated by reference into these Terms.
4. Client responsibilities
- Provide accurate information, required content, brand assets, approvals, and access credentials needed to complete work.
- Respond to review requests and feedback in a reasonable timeframe to avoid project delays.
- Confirm that any text, images, trademarks, and media provided for your site can be lawfully used.
5. Timeline and delivery
Estimated timelines are based on normal response and approval cycles. Delays in feedback, content delivery, or required access can extend delivery dates.
6. Ownership and intellectual property
- Upon full payment for the work described on your invoice (or written agreement for custom projects), you receive ownership of final website deliverables created for your project, unless otherwise stated in writing.
- Third-party tools, licensed assets, stock media, fonts, plugins, or platform components remain subject to their own license terms.
- Jace Web Design may display non-confidential project work in a portfolio unless you request otherwise in writing.
7. Monthly care plan terms
If you enroll in the care plan, support is provided as described on the website and in any written agreement. Care plan cancellation and billing treatment are handled under the Refund and cancellation policy.
8. Acceptable use
You agree not to use services for unlawful content, malicious activity, or activity that violates the rights of others. Jace Web Design may suspend or decline work where continued service would violate law, third-party terms, or platform policy.
9. Third-party services
Projects may involve third-party providers (for example domain registrar, hosting, forms, analytics, or payment tools). Jace Web Design is not responsible for outages, policy changes, or actions of third-party services outside direct control.
10. Disclaimer of warranties
Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Jace Web Design disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Jace Web Design is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost data, or business interruption. Total liability for any claim related to services will not exceed the amount paid for the specific service giving rise to the claim.
12. Termination
Either party may end a project in writing. Fees, deliverables, and refunds after termination follow the written agreement and the Refund and cancellation policy.
13. Governing law and venue
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles. Any legal dispute will be brought in a court of competent jurisdiction located in Utah, unless otherwise required by law.
14. Changes to these Terms
Jace Web Design may update these Terms from time to time. The "Last updated" date will reflect the latest revision. For active projects, the version in effect at the time of purchase generally applies unless both parties agree otherwise in writing.
